Details of Will

I, Peircy Jones of Badsey, give:

  • To my dear wife Elizabeth Squire Jones, all that my new built messuage or tenement with the garden and appurtenances to the same belonging situate in Badsey and now in the occupation of my eldest son John Jones for the term of her natural life and after her death I give the same messuage tenement garden and premises to my son Peircy Jones
  • To my dear wife one annuity or yearly rent charge of £31 10s to be payable during the term of her natural life by my three sons, John, Peircy and Joseph Jones in equal shares out of the respective premises given to them, in lieu of all dower
  • To my good friend William Collett of Badsey, farmer, all that my messuage farm and lands with the appurtenances in Badsey now in my own occupation to hold for the term of 1000 years upon the trusts and for the uses interests and purposed hereinafter mentioned.  I give and devise the same messuage farm and lands to my eldest son John Jones to hold to him for and during the term of his natural life and from and immediately after his decease subject as aforesaid I give the same premises to the use of the first son of John Jones lawfully begotten and his heirs and in default of such issue subject as aforesaid to the use of the second third fourth and all and every other that son and sons of the said John lawfully begotten and in remainder and after that other in order as they shall respectively be in priority of birth, and if not daughters, and in default of such issue subject as aforesaid to the use of my two sons Peircy Jones and Joseph Jones and their heirs for ever in equal dividends as tenants in common and as to …. The said William Collett upon trust that he, his executors and assigns shall by mortgage of the said messuage farm lands and premises for the said term of 1000 years raise and levy and charge that said premises with the sum of £970 with 12 months with interest and do immediately pay £700 part thereof to my son Peircy Jones and which said sum of £700 I do hereby give to my son Peircy Jones and £270 the residue thereof to my son Joseph Jones and which said mortgage I order and direct to remain charged on the said estate until John Jones and any of his heirs shall by law be able to bar and destroy the several estates hereinbefore devised and limited to him.  In the event of my eldest son dying without issue, my sons Piercy Jones and Joseph Jones shall have the estates charged with the said £970
  • But it is also my will that my son John and his issue shall pay and keep down the sum of £970 so owing? As the same shall ? the ? on the said estate
  • I also give to my son John all the live and good stock and implements of husbandry which shall be on or particularly belonging to the said farm and lands devised to him as aforesaid at the time of my decease
  • To my son Peircy Jones all new corn grain hay and fodder which shall at the time of my decease be standing growing or baling? In or upon all and every part of the lands and premises I occupy being in the parish of Offenham and any thing which shall at the time of my death be upon the several lands and premises belonging to me together with the immediate possession of the said farm lands and premises and all my? And estate except the live stock and implements of husbandry The livestock and implements I do desire may be considered part of the residue of my personal estate
  • To my son Peircy Jones all my messuage or tenement and garden to the same situate at Badsey adjoining to the before mentioned new erected messuage or tenement hereinbefore given to my wife and which messuage or tenement is now in the occupation of my son John, to give to the use of my son Peircy Jones (from and immediately after my demise) his heirs and assigns for ever
  • To my son Joseph Jones all my estate lands hereditaments and premises whatsoever situate in the parish of Willersey, Glos, called Condercup together with the crops of corn, grain and hay and all other things which shall at the time of my death be standing growing or being in or upon any part of the same
  • To my son Joseph Jones all that my estate lands and premises situate in the parish of South Littleton and now in the occupation of John Perkins to hold for and during all my state
  • To my son Joseph Jones all that my copyhold messuage or tenement lands and premises situate in the parish of Cleeve Prior and which I now hold under the Dean and Chapter of Worcester
  • It is my will and the ? interest and ?saking of these presents that in case my brother Francis Jones of Badsey shall not by his last will devise to my son Peircy Jones his estate lands hereditaments and premises situate in the parish of Offenham now in my occupation called Blackminster, immediately after the decease of my brother…
  • To my son Joseph Jones so far in respect my estate lands and premises in the parish of Willersey called Condercup and all the estates and interest I have hereby before given to him
  • And I give the same estate farm lands hereditaments and premises situate at Willersey to my son Peircy Jones for ever from immediately after the decease of my brother Francis Jones in the event of his dying without giving my son Peircy Jones his estate called Blackminster
  • And I hereby charge the same estate and premises at Willersey in case of its coming to my son Peircy Jones in manner and on the event aforesaid with the payment of the same at £400 to my son Joseph Jones
  • I give the same £400 to Joseph Jones and I do charge the said estate and premises in the event of same owing to my son Peircy Jones the said sum of £400 and I direct that the said legacy or sum of £400 shall be paid by Peircy Jones to Joseph Jones within 12 months after the decease of my brother Francis Jones
  • I give to John Jones my silver tankard
  • As to all the rest residue and remainder of my personal estate and effects and not hereinbefore given and disposed of by me I will and desire them immediately or as soon after my decease as properly and conveniently may be ? and that the money arising from such residue of my said personal estate I desire and direct to be divided into three equal parts or share or equal terms
  • I give to my son John Jones one other equal part thereof
  • To my son Peircy Jones and the remaining or other third part thereof
  • To my son Joseph Jones
