          Case for exemption
Mr Geoffrey New appeared for Thomas William Hardiman (29), married, South View, Badsey, market gardener. He had previously been exempted conditional on his partner, J J Pethard, serving. Pethard had been passed by the Medical Board for C3, and consequently has not been called up. The military now applied for a review of Hardiman’s certificate. Mr New argued that Hardiman was exempted conditional on Pethard serving “when called up”; he was quite willing to serve when called up. Mr Cholmondeley maintained that the condition did not hold as Pethard would not under present orders be called up. Hardiman said they had 11 acres of land; Pethard was not capable of managing it.
          Outcome of appeal
              Military application refused
